Restrictions on outbound foreign investment: Semiconductors, quantum computing, and AI investments in the spotlight

The long-awaited Executive Order (EO) to curb outbound US investments in companies in certain countries of concern, most importantly China, that develop certain technologies and products sensitive to national security, once adopted, will be immensely impactful on cross-border investment and development in certain high-tech sectors, including semiconductors and microelectronics, quantum computing, and artificial intelligence (AI) systems.

Simultaneous with the release of the EO, the Department of Treasury also released an Advanced Notice of Proposed Rulemaking (ANPRM) that provides clarification and details on the intended scope and mechanisms of the planned regulations and seeks public and stakeholder engagement and comments to help shape the regulations.
